Terms & Conditions


Introduction
Welcome to Clear Path Community Wellness (CPCW). By using our platform and or creating an account, you agree to the terms and conditions in this agreement. CPCW is a referral platform connecting Community Members and independent wellness Providers. Please read these terms carefully. This agreement applies to all users, whether Providers or Community Members.


1. Definitions

  • Provider: Any individual or entity offering mental health, wellness, or related services through CPCW, including but not limited to licensed therapists, counselors, psychologists, social workers, coaches, and other wellness practitioners.
  • Community Member: Any individual who uses the CPCW platform for services, events, workshops, or networking but does not provide wellness services.
  • Participant: A Community Member or Provider who participates in events, workshops, or classes hosted by CPCW.

2. Role of CPCW

CPCW is solely a referral platform and does not provide or manage mental health or wellness services. All services are delivered by independent providers, who are not employees, contractors or agents of CPCW. CPCW does not supervise, verify, or endorse any Provider’s qualifications, credentials, or services.


3. Responsibilities of Community Members

Community Members are responsible for selecting and assessing the suitability of Providers. CPCW does not verify credentials, licenses, or insurance and makes no guarantees about Provider qualifications. Community Members are advised to independently evaluate any Provider they choose to engage with through CPCW.


4. Responsibilities of Providers

Providers agree to:

  • Maintain professional liability insurance.
  • Comply with all applicable laws, including privacy and confidentiality regulations (e.g., HIPAA).
  • Maintain current and valid professional licenses and credentials.
  • Accurately represent qualifications on the platform and accept insurance only for companies they are authorized to contract with.

Providers operate independently and are solely responsible for managing client information securely, including compliance with HIPAA regulations regarding Protected Health Information (PHI).


5. Events and Community Activities

CPCW may host events, workshops, or networking opportunities. Participation in these activities is voluntary, and Participants assume all risks. CPCW is not liable for any injuries, damages, or outcomes resulting from these activities. By participating, Participants agree to release CPCW from all claims related to these events.


6. Membership Fees

Community Members and Providers may be required to pay a monthly membership fee. CPCW reserves the right to terminate membership for any breach of these terms or failure to maintain professional standards.


7. Fee, Discount and Flexible Pricing Policy

While CPCW (“Clear Path”) acknowledges and supports the practice of providers offering sliding scale fees and discretionary discounts to Community Members, such fee arrangements are neither mandatory nor guaranteed. Any decision to offer reduced fees, sliding scale payment arrangements, or discounts (collectively, “Fee Adjustments”) shall be: a) Made solely at the individual provider’s discretion; b) Determined on a case-by-case basis; and c) Subject to the provider’s own criteria and business judgment. Clear Path: a) Makes no representations or warranties regarding the availability of Fee Adjustments; b) Does not require, mandate, or enforce any Fee Adjustment policies upon its providers; and c) Is not responsible for establishing, maintaining, or mediating any Fee Adjustment arrangements between providers and Community Members. Clear Path expressly disclaims any liability arising from: a) The availability or unavailability of Fee Adjustments; b) Any disputes or misunderstandings regarding Fee Adjustments; or c) Any expectations of Community Members regarding the availability of Fee Adjustments. Community Members acknowledge and understand that Fee Adjustments are not guaranteed and should not be presumed available without explicit confirmation from individual providers.


8. Limitation of Liability

CPCW is not liable for indirect, incidental, or consequential damages arising from the use of its platform, services, or events. CPCW’s total liability is limited to the amount of membership fees paid within the last 12 months. CPCW is not responsible for the acts, omissions, or professional conduct of Providers, and Community Members are encouraged to report any misconduct directly to relevant licensing boards or authorities.


9. Data Protection and Privacy

CPCW values your privacy. CPCW collects personal data as outlined in our Privacy Policy and uses it to facilitate connections between Community Members and Providers.

  • Community Members and Providers are responsible for using secure devices and networks when accessing the platform. CPCW is not liable for data breaches caused by user negligence.
  • Community Members may revoke their consent to share data with Providers at any time by notifying CPCW in writing.

10. Governing Law and Dispute Resolution

This agreement is governed by Colorado law. Any disputes shall be resolved through mediation or binding arbitration in Jefferson County, Colorado. Both parties agree to attempt mediation before arbitration.


11. Modifications to this Agreement

CPCW reserves the right to modify this agreement at any time. Users will be notified of changes through the platform.



Privacy Policy

Introduction

Clear Path Community Wellness (CPCW) values your privacy. This Privacy Policy outlines how we collect, use, and protect your personal information when you use our platform.


1. Information We Collect

We collect personal information that you voluntarily provide when signing up for our services, such as your name, contact information, and relevant health information necessary for referrals. We may also collect information about your use of the platform, such as browsing data, through cookies.


2. How We Use Your Information

We use the information you provide to facilitate connections between Community Members and providers, process referrals, and improve the platform. Your data is also used to send relevant updates about your services and memberships.


3. Sharing Information with Providers

When you choose to connect with a provider through CPCW, we share only the necessary personal information with that provider to facilitate your care. Providers are independently responsible for maintaining the confidentiality and security of Community Member information in compliance with HIPAA and other relevant privacy laws.
Community Members may revoke their consent to share personal information with Providers at any time by notifying CPCW in writing. Once consent is revoked, CPCW will cease sharing information; however, Providers remain responsible for any data previously shared.


4. Data Protection

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, disclosure, or alteration. However, we cannot guarantee the security of data transmitted over the internet.
Clients and Providers are responsible for ensuring that they use secure devices and networks when accessing the platform. CPCW cannot be held liable for any unauthorized access or loss of data resulting from a user’s failure to implement adequate security measures on their personal devices.


5. Cookies and Tracking

We use cookies to enhance your experience on our platform. These cookies allow us to track usage patterns, preferences, and account sessions. You may adjust your browser settings to block cookies, but doing so may limit your ability to use certain features of our platform.


6. Third-Party Services

CPCW may use third-party services, such as payment processors or video conferencing platforms, in connection with the platform. These services have their own privacy policies, and CPCW is not responsible for the practices of third-party providers.


7. Your Rights

You have the right to access, update, or delete your personal information at any time. If you wish to exercise these rights or have any concerns about how your data is handled, please contact us at [contact information].

We retain personal data for the duration of the user’s membership and for up to five years following the termination of services or as required by applicable law.

This Privacy Policy is governed by the laws of the State of Colorado. Any disputes related to this policy shall be resolved in Jefferson County, Colorado.
